Français

1. Purpose

These Terms of Use (the “Terms”) govern access to and use of the Plate service (the “Service”), published by Melvyn Mollard-Grech, sole trader (entrepreneur individuel), under the trade name Plate (“Plate”, “we”). The Service lets restaurant owners create, manage and share a digital restaurant menu with professional photos enhanced by artificial intelligence, accessible through a QR code.

2. Acceptance of the Terms

Using the Service implies full acceptance of these Terms. If you do not accept them, you may not use the Service.

By creating an account, you confirm that you have read, understood and accepted these Terms and our Privacy Policy. You also confirm that you are at least 18 years old and have the legal capacity to enter into a contract.

3. Description of the Service

Plate provides restaurant owners with:

  • A mobile app (iOS and Android) to photograph, manage and publish their restaurant menu
  • Automatic AI processing of photos (background removal, enhancement of dishes)
  • A public digital menu page, opened by the restaurant's guests through a QR code
  • A dashboard with scan and usage statistics
  • A personalised QR code and a physical kit (stickers or laminated cards, depending on the plan)
  • Automatic translation of the menu into several languages

4. Registration and account

To access the Service, you must create an account with a valid email address and a password, or sign in with Apple or Google. You are responsible for keeping your credentials confidential and for all actions taken from your account.

If your credentials are lost or compromised, contact us immediately at support@plate.center.

One account is allowed per restaurant. Creating multiple accounts to get around the limits of the Service is prohibited.

5. Subscription and payment

The Service is offered as a monthly subscription, whose price depends on the plan chosen (Essential or Complete). On the website, prices are shown in euros, all taxes included; in the iOS app, Apple displays and charges the price in your country's currency.

Free trial: when a trial period is offered, no payment card is required to start it. At the end of the trial, the Service is suspended unless you subscribe to a paid plan.

Renewal: subscriptions renew automatically. You can cancel at any time from your subscription settings. Cancellation takes effect at the end of the current period; no refund is given for a period already started.

Payments made on the website are processed by Stripe. Plate never has access to your card details.

Subscriptions purchased in the iOS app are billed by Apple to the payment method of your Apple Account and renew automatically until cancelled. You can manage and cancel them in your Apple Account settings (Settings → your name → Subscriptions) at least 24 hours before the renewal date; refunds follow Apple's terms. The Apple Standard End User License Agreement also applies to the iOS app.

6. Physical kit

Depending on the plan, a physical kit (QR stickers or laminated cards) is included and shipped to the delivery address you provide.

The kit ships after the first actual payment — that is, at the end of the trial when the subscription was started with a trial. Indicative delivery time is 5 to 10 business days in mainland France; outside France, the delivery time is given at shipping.

If the kit is lost or proven defective, contact us and we will send a replacement. The kit cannot be refunded separately from the subscription.

7. User obligations

By using the Service, you agree to:

  • Provide accurate and up-to-date information about your restaurant and your dishes
  • Only publish photos and descriptions that match your real dishes (no misleading editing)
  • Not publish unlawful, misleading, defamatory or obscene content, or content that infringes third-party rights
  • Not attempt to bypass the security mechanisms of the Service
  • Not use the Service for any purpose other than managing your professional restaurant menu
  • Respect intellectual property rights (photos, logos, trademarks)
  • Comply with applicable regulations (price display, allergens, mandatory information)

8. User content

You remain the owner of all content you publish on Plate (original photos, dish names, descriptions, prices). You grant Plate a worldwide, non-exclusive, royalty-free and sublicensable licence to host, display and distribute this content for the purpose of providing the Service.

Plate may use screenshots or excerpts of menus (anonymised, or with your consent) to present the Service commercially (website, social media, marketing materials).

9. Intellectual property

The Plate Service, including its interface, code, AI processing, trademarks, logos and all content created by Plate, is protected by applicable intellectual property rights.

Any unauthorised reproduction, redistribution or exploitation of the Service or any of its components is strictly prohibited.

10. Availability and maintenance

Plate strives to keep the Service available 24/7 but cannot guarantee uninterrupted availability. Scheduled maintenance may cause temporary interruptions, announced in advance whenever possible. Plate cannot be held liable for interruptions caused by third parties (hosting providers, network operators, etc.).

11. Limitation of liability

The Service is provided “as is”. Plate does not guarantee that the Service will meet all your expectations or be free of errors.

To the extent permitted by law, Plate's liability is limited to the amounts paid during the 12 months preceding the event giving rise to the damage. Plate cannot be held liable for indirect losses, loss of profit or loss of customers.

Plate is not responsible for content published by users or for the accuracy of the information displayed on restaurant menus.

12. Termination

By you: you can cancel your subscription at any time from the subscription settings. You can also delete your account from the Account tab (irreversible). Cancellation ends access to the Service at the end of the current paid period.

By Plate: Plate may suspend or terminate your account without notice in the event of a serious breach of these Terms (unlawful content, fraud, hacking attempts, etc.).

13. Your guests’ data — data processing (Article 28 GDPR)

When your guests use your menu (loyalty programme, table or takeaway ordering, private feedback), Plate processes their data on your behalf. You are the controller of this processing; Plate is the processor. This section is the data processing agreement required by Article 28 of the GDPR.

Subject and duration. Running the Plate services you enable, for as long as your account exists. Data subjects: your establishment's guests. Data: phone number, first name, birthday (day and month), visit and reward history, order contents, table number, private feedback message. No special category data within the meaning of Article 9 is requested.

Plate undertakes to:

  • process this data only to provide the Service, following your instructions — including the settings you choose in your account —, never for its own purposes, never for advertising, and never sell it;
  • keep this data confidential and limit access to the people who need it to provide the Service;
  • implement the security measures described in the Privacy Policy (encryption, strict isolation between restaurants, access control, logging);
  • only use the sub-processors listed in the Privacy Policy, bound by equivalent obligations; you are notified by email of any addition or replacement at least 30 days in advance and may object by cancelling at no cost;
  • help you answer your guests' requests: you can delete a guest from your account, and Plate forwards and carries out any request it receives directly;
  • notify you of any personal data breach affecting your guests within 48 hours of becoming aware of it, with the information you need for your own notification to the supervisory authority;
  • apply the published retention periods and, at the end of the contract, delete this data — you can export it at any time beforehand (Account → Export my data);
  • make available, on request to support@plate.center, the information needed to demonstrate compliance with these obligations.

For your part, you agree to inform your guests (Plate displays a notice at every point of collection), to collect only what your business needs, and to handle the requests they send you.

14. Changes to the Terms

Plate may change these Terms at any time. Material changes are notified by email at least 30 days before they take effect. Continuing to use the Service after that date constitutes acceptance of the new Terms.

15. Governing law and jurisdiction

These Terms are governed by French law. In the event of a dispute, the parties will seek an amicable solution before any legal action. Failing an amicable agreement, the competent courts of Paris will have sole jurisdiction, unless mandatory legal provisions provide otherwise.
